Rome I & Rome II - Law Applicable to Contractual and Non-Contractual

The future Rome I Regulation aims to complete the harmonisation of the rules of private international law relating to contractual obligations, such as those arising from consumer and employment contracts. The Rome II Regulation has been recently published and will enter into force in January 2009. Its intention is to create a set of rules to determine which law is applicable to non-contractual obligations, for example in international road traffic accidents.

The conference will give an analysis of the future Rome I Regulation and of the Rome II Regulation, highlighting aspects such as the principle of choice of law and the applicable law in the absence of choice in the case of Rome I, and product liability, unfair competition and the infringement of intellectual property rights in the case of Rome II. It will also provide a forum for debate between legal practitioners, especially judges and private practitioners, experts in Member States’ ministries and EU legislators.

The opening speech will be delivered by Portuguese State Secretary João Tiago da Silveira. Among the other conference speakers will be academic experts on European private law from all involved EU Presidency countries and representatives of the European Commission Legal Service, the Portuguese Constitutional Court and the German Ministry of Justice.
